Assault And Battery
Assault and Battery is when one person tries or physically strike a person and/or acts in a threatening manner, placing an individual in fear of immediate harm. More serious assaults or batteries occur when an individual tries or does cause severe injury with a deadly weapon. Penal Code Section 240-243. Penal Code Section 245(A) (assault with a deadly weapon). Typically the threat of physical injury is an "assault" and unlawful offensive touching is considered to be a "battery".
